在新时代高水平对外开放深化与全球治理体系变革的双重背景下,国际仲裁人才作为涉外法治人才队伍的核心支柱,其培养质量关乎我国跨境争议解决能力建设,影响我国在国际法治领域话语权的提升。实践导向是涉外法治人才培养的本质要求,协同培养则是破解当前人才培养体制机制瓶颈的关键路径。本文紧扣习近平总书记关于涉外法治人才培养的论述,厘清国际仲裁人才培养的实践内涵与内在逻辑;通过深入剖析我国国际仲裁人才培养的体制机制障碍,明确协同培养的核心研究命题;从主体联动、全流程实践融入视角构建协同培养体系,确立制度保障框架;最后聚焦法律院校这一主阵地,提出具体实施路径。本研究旨在为打造通晓国际规则的国际仲裁人才队伍提供理论支撑与实践指引,助力我国参与全球争议解决体系治理。
Abstract:Against the dual backdrop of the deepening of high-level opening-up in the new era and the transformation of the global governance system, international arbitration professionals, as the core pillar of the foreign-related rule-of-law talent pool, are integral to the development of China's cross-border dispute resolution capacity, and the quality of their cultivation directly bears upon the enhancement of China's voice in the field of international rule of law. Practice-oriented training constitutes the essential requirement for cultivating foreign-related rule-of-law talents, while collaborative training represents the key pathway to addressing existing structural and institutional bottlenecks in talent cultivation. Closely following General Secretary Xi Jinping's important expositions on the cultivation of foreign-related rule-of-law talents, this paper clarifies the practical connotations and internal logic of international arbitration talent cultivation; through a systematic analysis of the structural and institutional barriers in China's international arbitration talent cultivation, it identifies the core research proposition of collaborative training; from the perspectives of multi-actor coordination and full-process practical integration, it constructs a collaborative training system and establishes a corresponding framework of institutional safeguards; finally, focusing on law schools as the principal arena, it proposes concrete implementation pathways. This study aims to provide theoretical support and practical guidance for building a team of international arbitration professionals well versed in international rules, thereby facilitating China's participation in the governance of the global dispute resolution system.
